Starn O’Toole Marcus & Fisher, a Honolulu law firm that filed a Hawaii class action lawsuit relating to the Volkswagen emissions litigation, announced that on December 3, 2015, a seven-judge committee known as the Judicial Panel on Multi - District Litigation is scheduled to hold a hearing in New Orleans that will likely affect the more than 400 federal civil lawsuits that have been filed against Volkswagen. The Court is expected to designate which federal court will handle the pretrial proceedings for these lawsuits. Wherever the case goes, lead counsel and a “plaintiffs’ steering committee” will be selected to help lead the prosecution of the cases. For individual owners who have inquired about the “Goodwill Package” offered by Volkswagen, the gift cards offered by Volkswagen are reported to not come with strings attached, and if that is true, redeeming them would not have an effect on the lawsuit. However, if there are any restrictions relating to the Goodwill Package, they could preclude the owners from being in the lawsuit.
The law firm filed a class action complaint against Volkswagen for fraudulent conduct and deceptive acts and practices on behalf of consumers in Hawaii on September 20, 2015.
